ELECTRONIC FUND TRANSFER DISCLOSURE STATEMENT
 
This disclosure statement sets forth your rights and obligations as a user of the electronic fund transfer services which Lewisburg Banking Company offers.  It is also a statement of Lewisburg Banking Company’s rights and obligations as a provider of electronic fund transfer service.
 
Consumer’s Obligations
If you believe your Money Card or Personal Identification Number has been lost or stolen, and you tell us within 2 business days after you learn of the loss or theft, you can lose no more than $50 if someone used your Money Card without your permission.
If you do NOT tell us within 2 business days after you learn of the loss or theft of your Money Card or Personal Identification Number, and we can prove we could have stopped someone from using your Money Card without your permission if you had told us, you could lose as much as $500.
Also, if your statement shows transfers that you did not make, tell us at once.  If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time.
If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.

Lewisburg Banking Company Business Days
Our business days are Monday through Friday.  Bank holidays are not included.  Our lobbies are open on Saturday however fund transfers will not be posted until the next business day.
 
Types of Available Transfers
You may use your Money Card to:
·          Withdraw cash from your checking or regular savings account.
·          Make deposits to your checking or regular savings account..
·          Transfer funds between your checking or regular savings accounts whenever you request.
·          Transfer funds from your checking or regular savings account to pay Lewisburg Banking Company Loan Accounts.
·          You have the ability to make ACH-Type transactions (i.e., ARC, POP, WEB, TEL, ect).
 
Some of these services may not be available at all terminals.  You may also authorize Lewisburg Banking Company to automatically debit or credit your accounts at Lewisburg Banking Company for payments to or from third parties.
 
Limitations on Frequency and Dollar Amounts or Transfers
For security reasons, there are limits on the number of transfers you can make and the dollar amounts you can withdraw from Lewisburg Banking Company Money Machines each day.  There are also limits established as to the amount which may be accessed in a single day through use of the Debit Card.  There are 3 free withdrawals/transfers per month from a regular savings account.  Money market and Savings Accounts 

During any calendar month or statement cycle of at least four weeks, you may not make more than six withdrawals or transfers to another account of yours or to a third party by means of a preauthorized or automatic transfer, telephone order or instruction, check, draft, debit card (if applicable) or similar order to a third party. If you exceed the transfer limitations set forth above in any statement cycle, your account will be subject to closure by the financial institution

 

 

 

 

 

 

 

Charges
There will be a $3.00 charge per withdrawal over 3 per month from a savings account.
At non-Lewisburg Banking Company ATM’s, we will charge your account $1.00 for any withdrawals from checking or savings.
 
Right to Documentation of Transfers
You can get a receipt at the time you make any transfer to or from your account using one of our Lewisburg Banking Company Money Machines.
If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, you can call us at 270-755-4818 to find out whether or not the deposit has been made.
You will get a monthly account statement unless there are no transfers in a particular month.  In any case, you will get the statement at least quarterly.
 
Right to Stop Payment of Preauthorized Transfers
If you have told us in advance to make regular payments out of your accounts, you can stop any of these payments.
Here’s how:
 
Call us at 270-755-4818 or write us at Lewisburg Banking Company, P.O. Box 278, Lewisburg, Ky.  42256, in time for us to receive your request 3 business days or more before the payment is scheduled to be made.  If you call, we may also require you to put your request in writing and get it to us within 14 days after you call.
If these regular payments may vary in amount, the person or company you are going to pay will tell you, 10 days before each payment, when it will be made and how much it will be.
If you order us to stop one of  these payments 3 business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.
 
Lewisburg Banking Company’s Obligations
If we do not complete a transfer to or from your account on time or in the correct amount, according to our agreement with you, we will be liable for your losses or damages.  However, there are some exceptions.  We will not be liable for instance:
·          If through no fault of ours, you do not have enough money in your account to make the transfer.
·          If you are attempting to draw against deposits of checks, drafts, or other non-cash items that have not yet been collected.  Generally, a check is collected when we present it to the bank it is drawn on and that bank pays us its value.
·          If you are attempting to draw against funds deposited in a Money Machine before the amount of your deposit has been manually verified by us and credited to your account.
·          If the Money Machine where you are making the transfer does not have enough cash.
·          If the Money Machine was not working properly and you knew about the breakdown when you started the transfer.
·          If circumstances beyond our control (such as fire, flood, or computer system failure) prevented the transfer despite reasonable precautions that we may have taken.
·          If the funds in the account have been offset by Lewisburg Banking Company in payment of a delinquent loan or if the funds have been attached or otherwise proceeded against as a result of a lawsuit that someone has brought against you or against a joint depositor on your account.
 
ATM Fees
When you use an ATM not owned by us, you may be charged a fee by the ATM operator [or any network used] (and you may be charged a fee for a balance inquiry even if you do not complete a fund transfer).
 
Disclosure of Account Information to Third Parties
We will disclose information to third parties about your account or the transfers you make as follows:
·          Where it is necessary for completing transfers.
·          In order to verify the existence and condition of your account for a third party such as a credit bureau or merchant.
·          In the event we close your account due to a deficit balance or excessive overdrafts.
·          In order to comply with government agency or court rules, or
·          If you give us your written permission.
 
In Case of Errors or Questions About Your Electronic Transfers
Telephone us at 270-755-4818 or,
Write us at:    Lewisburg Banking Company, P.O. Box 278, Lewisburg, Ky.  42256; as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on your statement or receipt.  We must hear from you no later than 60 days after we sent the First statement on which the problem or error appeared.
1. Tell us your name and account number, (if any).
2. Describe the error or transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
3. Tell us the dollar amount of the suspected error.
 
If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.
We will tell you the results of our investigation within 10 business days after we hear from you and we will correct any error promptly.  If we need more time, however, we may take up to 45 days to investigate your complaint or question.  If we decide to do this, we will recredit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation.  If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not recredit your account.
If we decide that there was no error, we will send you a written explanation within 3 business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.
 

 

FUNDS AVAILABILITY POLICY

 

 

NEXT-DAY AVAILABILITY

 

 

 

Our policy is to make funds from your deposits to accounts with unlimited checking capabilities available to you on the first day after the day we receive your deposit.  Electronic direct deposits will be available on the day we receive your deposit.  At that time, you can withdraw the funds in cash and we will use the funds to pay checks you have written.  For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and Federal holidays.

 

 

If you make a deposit before 4:00 p.m. Monday through Thursday and 5:00 p.m. on Friday at either our main office located at 287 North Main Street, Lewisburg, Kentucky, or our branch office located at 780 Hopkinsville Road, Russellville, Kentucky, with a staffed teller, on a business day that we are open, we will consider that day to be the day of your deposit.  If you make a deposit before 3:00 p.m. Monday through Friday at our branch office located at 200 Armory Drive, Russellville, Kentucky, with a staffed teller, on a business day that we are open, we will consider that day to be the day of your deposit.  If you make a deposit after 3:00 p.m. Monday through Friday at our Armory Drive Branch, with a staffed teller, on a business day that we are open, then we will consider the next business day to be the day of your deposit. If you make a deposit after 3:00 p.m. Monday through Friday at our branch office located at 109 Park Avenue, Adairville, Kentucky, with a staffed teller, on a business day that we are open, then we will consider that day to be the day of your deposit. If you make a deposit after 3:00 p.m. Monday through Friday at our Adairville Branch, with a staffed teller on a business day that we are open then we will consider the next business day to be the day of your deposit. However, if you make a deposit with a staffed teller during business hours on Saturday or in the Night Depository after closing hours or on a day we are not opened, we will consider that the deposit was made on the next business day we are open.

 

 

LONGER  DELAYS  MAY  APPLY

 

 

In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit.  Depending on the type of check that you deposit, funds may not be available until the Second business day after the day of your deposit.  However, the first $200 of your deposits will be made available on the first business day.

 

 

If we are not going to make all of the funds from your deposits available on the first business day, we will notify you at the time you make your deposit.  We will also tell you when the funds will be available.  If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the day after we receive your deposit. 

 

 

In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

 

 

  • We believe a check you deposit will not be paid.

     

  • You deposit checks totaling more than $5,000 on any one day.

     

  • You redeposit a check that has been returned unpaid.

     

  • You have overdrawn your account repeatedly in the last six months.

     

  • There is an emergency, such as a failure of communications or computer equipment.

     

 

We will notify you if we delay your availability to withdraw funds for any of these reasons, and we will tell you when the funds will be available.  They will generally be available no later than the Seventh business day after the day of your deposit.

 

 

HOLD ON OTHER FUNDS

 

 

If we cash a check for you that is drawn on another financial institution, we may withhold the availability of a corresponding amount of funds that are already in your account. Those funds will be available at the time funds from the check we cashed would have been available if you had deposited it.
